Terms of Service

1. Acceptance

By creating an account, the parent accepts these Terms and the Privacy Policy on behalf of themselves and the child.

2. Eligibility

Parent must be 18+ and have legal authority to consent for the child. Child must be 3–12 (Phase 1: optimized for 5–9). Outside that range, contact us.

3. Account

Parent owns the account and is responsible for child use. One parent account per household recommended; multiple children supported (Phase 2).

4. Acceptable use

No scraping, no automated access, no reverse-engineering the tutor, no using Lumi to train competing AI models, no abusive content in interest tags, no sharing accounts.

5. Free service

Lumi is free in Phase 1. We may add paid features later; existing data and access to free features will continue free.

6. Intellectual property

Lumi, the mascot, biome art, curriculum sequence, tutor persona, and all software are owned by Digital Boutique AI. Curriculum content draws on the public-domain UFLI Foundations scope-and-sequence and CKLA open-license materials; specific attributions are listed at /credits.

7. AI disclosures

Lumi's tutor is powered by Anthropic Claude with a custom persona and student-state context. Voice is generated by ElevenLabs. AI responses are reviewed by automated safety filters but may occasionally err; parents are encouraged to review their child's session activity in the parent dashboard. Lumi is a supplement to, not a replacement for, parent or teacher instruction.

8. No medical / educational diagnosis

Lumi is not a diagnostic tool. If you suspect a learning difference (dyslexia, etc.), consult a qualified professional. Lumi can complement but does not replace evaluation.

9. Disclaimers

Service provided "as is" without warranty; no guarantee of specific learning outcomes.

10. Limitation of liability

To the maximum extent permitted, our liability is limited to $100 or the amount paid in the prior 12 months (whichever is greater). Carve-outs for fraud, willful misconduct, and rights that cannot be limited under applicable law.

Standard mutual.

12. Termination

Parent may delete account anytime; we may terminate accounts for ToS violation with notice and a 30-day data export window unless violation is fraud/abuse.

13. Dispute resolution

Informal resolution first (60 days), then arbitration in San Diego, CA under AAA Consumer Rules, with a small-claims and injunctive-relief carve-out. Class-action waiver (subject to applicable law).

14. Governing law

California, USA.

15. Changes

Material changes notified by email; continued use after notice is acceptance.
